1. What We Offer
Bitnova Now Inc., operating as Bitcoin Now (“Bitcoin Now,” “we,” “us,” “our”), runs a network of self-serve kiosks (each, an “ATM”) where you can buy digital currency with cash, along with the website at bitcoinnowatm.ca (the “Website”) that lists our ATM locations, current rates, and fees, and lets you sign up in advance. Buying digital currency at one of our ATMs is the “Service.”
Our ATMs currently support Bitcoin (BTC), Ethereum (ETH), Litecoin (LTC), and Tether (USDT) (each a “Supported Currency”). Which currencies are available can differ machine to machine and may change at any time — we may add or drop a Supported Currency without notice.
Every Bitcoin Now ATM is cash-in only: you can buy a Supported Currency with cash, but no machine or feature on the Website lets you sell digital currency back to us or cash out through the Service.
2. Who Can Use an ATM
You need to be 18 or older and physically in Canada when you transact. There’s no account or sign-up required to use a machine for a purchase under the daily verification threshold in Section 5 — you just need a compatible wallet address ready to receive your purchase.
Federal anti-money-laundering law (the Proceeds of Crime (Money Laundering) and Terrorist Financing Act, “PCMLTFA”) requires us to collect a government photo ID and additional information once your same-day purchases cross that threshold.
3. How a Transaction Works
Each purchase is a straightforward exchange: you hand over cash, we send the equivalent amount of your chosen Supported Currency to the wallet address you enter at the ATM. Before you confirm anything, it’s on you to double-check that address — that it’s typed correctly, that it actually accepts the currency you’re buying, and that it belongs to a wallet you control or intend to send to. Once digital currency reaches an address you gave us, we have no way to get it back and no responsibility for where it ends up if that address was wrong, incompatible, or provided by someone other than you.
4. What You’re Confirming When You Use the Service
By using an ATM or the Website (as a “User”), you’re telling us the following is true and that you accept it:
- (a) Digital currency prices move fast and unpredictably, and buying it can mean losing some or all of what you put in. You’re taking that risk on yourself — Bitcoin Now isn’t liable for value you lose through normal use of the Service. If that’s not acceptable to you, don’t use an ATM.
- (b) Under Canadian law, Bitcoin, Ethereum, Litecoin, Tether, and similar digital currencies aren’t legal tender and generally aren’t treated as property or an asset.
- (c) We’re not a bank, credit union, or any other deposit-taking institution — we don’t hold deposits for anyone. What we run is a cash-for-crypto exchange point.
- (d) Nothing we offer is a security, investment contract, or regulated financial instrument, and using an ATM isn’t trading or investing in one.
- (e) No legitimate government body will ever ask to be paid in Bitcoin or any other digital currency. We don’t let anyone use our machines on someone else’s behalf or under someone else’s direction. Before you transact, it’s your job — not ours — to be sure of why you’re buying and whose wallet you’re sending to, independent of anything a caller, text, or email told you. You confirm you’ve seen and understood the fraud-warning information posted at the ATM or on the Website, and that you’re acting on your own judgment, not anyone else’s instructions.
- (f) Once your purchase clears (allowing for normal blockchain confirmation time), the digital currency is fully yours — we keep no claim on it and you’re free to do whatever you like with it from that point on.
- (g) If Tether (USDT) or any other stablecoin is available through the Service, it’s meant to be bought as a payment tool or a store of value, not as an investment — you don’t earn interest or any return from us on it.
5. How You Pay & Transaction Limits
Our ATMs take cash only — no cards, e-transfer, or other electronic payment method at this time. We can change which bills a machine accepts, or add other payment options later, at our discretion.
Machines accept cash in $5 increments up to $995 per transaction, regardless of currency. With just phone verification, you can buy up to $1,000 total in a single day. Past that $1,000 daily mark, we need a government photo ID plus additional verification before you can keep transacting that day.
We can adjust these numbers, add other limits (by location, by user, by currency), or decline a transaction outright, at any time and without advance notice.
6. Verifying Who You Are
Depending on how much you’re buying that day, we may need your name, date of birth, and photo ID. You’re authorizing us — directly or through a verification partner — to check that information however we reasonably need to. That check can add delay, and we’re not responsible for any inconvenience it causes. If you’re asked for ID and don’t provide it, we can turn away the transaction. We’ll also refuse a transaction outright if we believe it’s connected to anything illegal, including breaking a purchase into smaller pieces to dodge a verification threshold.
We keep records of any verification you complete, to the extent PCMLTFA and other Canadian law require it of us.
7. Our Regulatory Status
Bitcoin Now operates as a Money Services Business under the PCMLTFA and maintains the identification, recordkeeping, and reporting practices that status requires, including reporting to FINTRAC. We may ask for ID, source-of-funds details, or other documentation as part of that compliance work, and we can refuse service to anyone, at any time, without giving a reason.
8. How We Set the Rate & Our Fee
The exchange rate shown on the ATM screen at the moment you confirm is what applies to your purchase — it comes from third-party pricing data that shifts constantly with the market. Anything shown on the Website is a rough guide only and can differ from the machine’s live rate; we don’t promise any particular rate will be available.
Our service fee is already folded into the rate you see before confirming — it’s not a separate line item. The size of that fee can depend on the location, the currency, and how much you’re buying.
9. Transactions Don’t Reverse
Every purchase through Bitcoin Now is final. Blockchain transactions can’t be recalled or reversed once they’re confirmed, so once your currency is sent, that’s it. If something goes wrong with the destination wallet itself, that’s a matter between you and whoever controls that wallet — we’re not part of that dispute and won’t get involved in recovering funds on your behalf.
10. Signing Up Through the Website
Using an ATM for a purchase under the daily verification threshold in Section 5 doesn’t require an account. Once you’re ready to buy above that threshold, or want to get set up in advance, you sign up through the Website by giving us your identifying information and a government photo ID and selfie photo, per Section 6.
Before you submit a sign-up, you’ll be asked to confirm you’ve read and agree to these Terms and our Privacy Policy. Submitting the form is how you accept both, and we rely on that confirmation the same way we’d rely on a signature. If you don’t agree to these Terms, please don’t submit the form.
Information you submit when signing up is used only to verify your identity and process your sign-up — see our Privacy Policy for how we handle it.
11. Content You Submit & Feedback
Anything you send us through the Website — a sign-up submission, a message through the contact form, a hosting inquiry, or an idea or suggestion about the Website or Service (together, “User Content”) — is your responsibility, not ours. We don’t screen or fact-check it, and we’re not liable for mistakes in it or for any harm that comes from someone relying on it.
Submitting User Content gives us a non-exclusive, royalty-free right to use, copy, adapt, and display it for running and improving the Service, and — for feedback or suggestions specifically — to act on it however we want without owing you anything for it. You’re confirming you actually have the right to grant us that, and that you had the right to share it in the first place.
12. Ownership of the Website
Everything on the Website besides User Content — text, design, branding — belongs to Bitcoin Now or our licensors and is protected under copyright, trademark, and related law. We give you a narrow, personal, non-commercial license to use the Website: you can browse it and submit its forms, but copying its content beyond that, or using the Bitcoin Now name, logo, or branding without our written OK, isn’t allowed.
13. Rules for Using the Service
We can limit or remove User Content, and suspend or cut off your access to the Service, whenever we decide to — we don’t have to justify it. We may also look at, keep, or hand over information when we reasonably think it’s needed to: (i) follow the law or respond to a legal or government request; (ii) enforce these Terms or look into a possible violation; (iii) catch or stop fraud or a security/technical problem; (iv) help with a support request; or (v) protect Bitcoin Now, our Users, or the public.
When you use an ATM or the Website, you agree not to:
- (a) Break any part of these Terms, including the eligibility rules;
- (b) Use the Service for anything illegal or fraudulent, including laundering money or splitting transactions to dodge a verification limit;
- (c) Post or send anything through the Website that’s unlawful, harassing, defamatory, obscene, or that infringes someone else’s rights;
- (d) Pretend to be someone else, or misrepresent your connection to a person or organization, including anyone on our team;
- (e) Try to disrupt, probe, or break into the Website or its infrastructure;
- (f) Physically tamper with, damage, or disconnect an ATM for any reason other than completing a normal transaction;
- (g) Break any law that applies to you, knowingly or not; or
- (h) Resell, sublicense, or otherwise commercially exploit the Website or Service without our written permission.
If we determine, or reasonably believe, that you’ve broken this Section, we can restrict, suspend, or end your access to the Service.
14. Outside Links & No Guarantees
Links on the Website to other sites or services aren’t run by us and aren’t an endorsement. We’re not responsible for what’s on those sites or how they operate — if you follow a link, you’re on your own and subject to that site’s own terms.
The Website and Service come as they are, with no promises attached. To the extent the law allows, we don’t guarantee anything about them — not merchantability, not fitness for a purpose, not accuracy, nothing express or implied.
We don’t guarantee any Supported Currency’s price or availability, and we don’t vouch for any third-party product or service advertised or linked through the Website. Nothing you hear or read from us creates a promise beyond what’s written in these Terms, and general information on the Website isn’t legal, tax, investment, or financial advice.
15. Limits on Our Liability
Buying and holding digital currency is inherently risky. Using the Service means you accept that we’re not on the hook for swings in a Supported Currency’s availability or value — including swings caused by regulators or other outside events.
To the extent the law allows, neither Bitcoin Now nor our subsidiaries, officers, employees, or agents (together, the “Bitcoin Now Parties”) are liable for damages tied to the Service — including damage from: (i) using, or being unable to use, the Website or Service; (ii) an error or inaccuracy on the Website or at an ATM; (iii) injury or property damage connected to using the Service; (iv) a bug or virus reaching you through the Website; or (v) any money, profit, or data you lose, or any disruption to your ability to use the Service. That holds even if we knew such damage was possible.
If we’re ever found liable to you for anything related to the Service or these Terms, the total we owe is capped at whichever is greater: the fee you paid on the transaction the claim is about, or everything you paid us in fees over the prior six months. If a data breach hits our systems despite reasonable, standard security measures being in place at the time, the Bitcoin Now Parties owe you nothing for it.
16. You’ll Cover Us If Something Goes Wrong on Your End
If a claim, cost, or legal fee comes our way because of something you submitted through the Website or because you broke these Terms, you agree to cover it.
17. We Can End Your Access
We can restrict or cut off your access to the Service or Website at any time, without notice — for example, if you break these Terms, if law enforcement asks us to, if we materially change or shut down the Service, if we hit a serious technical or legal problem, or if we believe you’re involved in fraud or other illegal activity. We won’t owe you anything for doing so.
18. Changes, Downtime & Updates to These Terms
We can change, pause, or shut down the Website or Service, in whole or in part, whenever we want and without notice. Machines and the site can go down for maintenance or a technical issue, and we can add or drop a Supported Currency at any time.
We can also update these Terms whenever we choose — whatever version is posted at the time you use the Service or submit a sign-up is the one that applies.
19. Sending Us Information
Nothing sent over the internet is fully secure, and we can’t promise the security of anything you send to or receive from the Website, or guarantee no one intercepts it. It’s on you to make sure what you send us is accurate — we’re not liable for information lost or misused in transit.
20. Entire Agreement; Severability; No Waiver
These Terms, together with our Privacy Policy, are the complete agreement between you and Bitcoin Now covering the Website and Service, replacing anything discussed before.
Should a court find part of these Terms unenforceable, only that part falls away — everything else stays in effect. And if we don’t act on a right under these Terms right away, that doesn’t mean we’ve given it up.
21. Governing Law
These Terms, and your use of the Service, are governed by the laws of Ontario and Canada. Any dispute goes to the courts of Toronto, Ontario, and you agree that’s the right venue.
22. Get in Touch
